Privacy Policy

Effective Date: September 6, 2026

Haitian Business Directory LLC (“HBD,” “we,” “us,” or “our”) respects your privacy. This Privacy Policy explains how HBD collects, uses, discloses, retains, and protects information when you use the Haitian Business Directory website, mobile application, business-directory services, and related features.

By using the Platform, you acknowledge the practices described in this Privacy Policy. If you do not agree with this Policy, you should not use the Platform.

1. Scope of This Policy

This Privacy Policy applies to information collected through the HBD website, mobile application, business-directory services, communications, and related features (collectively, the “Platform”).

It does not govern the privacy practices of businesses listed on HBD or third-party websites and services linked from the Platform. Those parties maintain their own privacy practices.

2. Information We Collect

Depending on how you use the Platform, we may collect the following categories of information.

2.1 Information You Provide

You may provide information such as:

  • Account information, including your name, email address, telephone number, username, password, and account preferences.
  • Business information, including a business name, category, description, owner or representative name, address, service area, telephone number, email address, website, operating hours, licensing information, photographs, logos, videos, and social-media links.
  • Verification information, including documents or other information used to confirm identity, authority, ownership, licensing, registration, or business status.
  • User Content, including reviews, ratings, photographs, comments, business responses, reports, messages, and other materials submitted to the Platform.
  • Transaction and billing information, including selected services, subscription status, invoices, transaction identifiers, and payment status. Complete payment-card information is generally collected and processed by our payment processor rather than stored directly by HBD.
  • Communications, including inquiries, customer-support requests, complaints, dispute information, survey responses, and other correspondence with HBD.
  • Marketing preferences and consent records.

2.2 Information Collected Automatically

When you use the Platform, HBD and its service providers may automatically collect:

  • Device and browser information, such as device type, operating system, browser type, language, application version, and device identifiers.
  • Internet and network information, such as Internet Protocol (IP) address, approximate location derived from an IP address, mobile carrier, and connection information.
  • Usage information, such as pages viewed, searches performed, listings visited, links selected, referring pages, session duration, dates and times of access, and interactions with Platform features.
  • Cookie and similar-technology information, including identifiers stored through cookies, pixels, software development kits, local storage, and comparable technologies.
  • Diagnostic and security information, such as crash reports, error logs, authentication activity, and suspected fraud or abuse.

2.3 Location Information

The mobile application may request permission to access your device’s precise location to show nearby businesses, improve location-based search results, provide directions, or enable another location feature clearly described at the time of collection.

HBD will request device permission before accessing precise location information. You can deny or withdraw permission through your device settings. Some location-based features may not work properly if location access is disabled.

HBD may also infer an approximate location from your IP address without accessing your device’s precise GPS location.

Business addresses and service areas submitted for publication are treated as directory information and may be displayed publicly.

3. How We Use Information

HBD may use information to:

  • Create, maintain, authenticate, and secure accounts.
  • Create, display, manage, verify, and promote business listings.
  • Provide directory search, location, review, messaging, and related features.
  • Process purchases, subscriptions, renewals, cancellations, credits, and refunds.
  • Communicate about accounts, transactions, security, verification, policy changes, and customer support.
  • Send marketing communications where permitted and consistent with your choices.
  • Personalize content and measure the effectiveness of listings, advertisements, and Platform features.
  • Analyze usage, diagnose technical problems, develop new features, and improve the Platform.
  • Detect, investigate, prevent, and respond to fraud, fake reviews, abuse, security incidents, and violations of our Terms and Conditions.
  • Comply with legal obligations, enforce agreements, and protect HBD, users, businesses, and the public.
  • Create aggregated or deidentified information that cannot reasonably identify an individual.

4. Cookies, Analytics, and Advertising Technologies

HBD may use cookies, pixels, software development kits, and similar technologies to operate the Platform, remember preferences, understand usage, maintain security, measure advertising, and provide relevant content.

We may use services such as Google Analytics and Meta Pixel. These providers may receive information about your device, browser, IP address, identifiers, pages viewed, and interactions with the Platform. They may process information under their own privacy policies.

Some advertising technologies may be considered targeted advertising, cross-context behavioral advertising, or a form of “sharing” under certain state privacy laws, even when no money is exchanged. Where required, HBD will provide a method to opt out.

Browser settings and device controls may allow you to block or delete cookies. Blocking necessary cookies may affect Platform functionality. Browser-based opt-out signals, such as Global Privacy Control, will be honored when required by applicable law.

5. How We Disclose Information

HBD may disclose information to:

  • Service providers that support hosting, cloud storage, analytics, payments, communications, security, customer service, verification, and Platform operations.
  • Advertising and analytics partners, including Google and Meta, as described in this Policy and subject to applicable choices and legal requirements.
  • Listed businesses when you intentionally contact, request information from, review, book, or otherwise interact with them.
  • Professional advisers, such as attorneys, accountants, auditors, and insurers.
  • Government agencies, courts, law enforcement, or other parties when disclosure is legally required or reasonably necessary to protect rights, safety, security, or the integrity of the Platform.
  • A buyer, successor, lender, investor, or adviser involved in a merger, acquisition, financing, reorganization, sale of assets, or similar business transaction.
  • Other parties when you direct us to disclose information or provide consent.

HBD does not sell personal information for money. HBD also does not knowingly sell or share the personal information of children under 18 for targeted advertising.

6. Public Information

Business listings, business contact information, reviews, ratings, photographs, business responses, and other content submitted for public display may be visible to anyone, including people who do not have an HBD account. Public content may also appear in search-engine results or be copied or shared by others.

Do not publish sensitive personal information in a business listing, review, comment, or other public area. A home address used as a public business address may be visible to Platform users.

7. Payments

Payments may be processed by independent payment providers. These providers may collect payment-card details, billing addresses, fraud-prevention information, and other information needed to complete a transaction.

HBD generally receives limited transaction information, such as the payer’s name, transaction identifier, amount, date, payment status, and limited card details. Payment providers process information according to their own terms and privacy policies.

8. Email, Telephone, and Text Messages

HBD may send transactional messages concerning accounts, listings, purchases, verification, security, and support.

With your consent or as otherwise permitted by law, HBD may also send promotional emails or text messages. Consent to receive marketing texts is not a condition of purchasing a product or service.

You may unsubscribe from marketing emails using the unsubscribe link in the message. You may opt out of marketing text messages by replying STOP or using another reasonable opt-out method. Message and data rates may apply.

Opting out of marketing communications does not prevent HBD from sending essential transactional or administrative communications.

9. Data Retention

HBD retains personal information only for as long as reasonably necessary for the purposes described in this Policy, including providing services, maintaining business and transaction records, resolving disputes, enforcing agreements, preventing fraud, and meeting legal obligations.

Retention periods vary according to the type of information, the nature of the relationship, legal requirements, security needs, and whether an account or listing remains active.

Public content may remain visible until removed by HBD or the account holder. Copies may remain temporarily in backups, legal records, security logs, or search-engine caches.

10. Data Security

HBD uses reasonable administrative, technical, and physical safeguards designed to protect personal information. These may include access controls, authentication measures, encryption where appropriate, monitoring, backups, vendor controls, and staff or contractor confidentiality requirements.

No website, application, network, or storage system can be guaranteed to be completely secure. You are responsible for maintaining the confidentiality of your password and for notifying HBD of suspected unauthorized account activity.

11. Your Privacy Choices

Depending on your relationship with HBD and applicable law, you may be able to:

  • Review or update certain account and business-listing information.
  • Request access to personal information HBD maintains about you.
  • Request correction of inaccurate personal information.
  • Request deletion of personal information, subject to legal exceptions.
  • Request a portable copy of certain information.
  • Opt out of targeted advertising, certain profiling, or the sale or sharing of personal information where applicable.
  • Withdraw consent for precise location access through device settings.
  • Opt out of marketing email or text communications.
  • Appeal a denied privacy request where required by law.

To exercise a privacy right, contact HBD using the information in Section 19. HBD may need to verify your identity and authority before completing a request. Authorized agents may submit requests where permitted by law. HBD will not unlawfully discriminate against you for exercising a privacy right.

12. State-Specific Privacy Rights

Residents of Florida and other U.S. states may have additional privacy rights when an applicable state law covers HBD’s activities. These rights may include access, correction, deletion, portability, and the ability to opt out of certain sales, sharing, targeted advertising, or profiling.

The Florida Digital Bill of Rights applies only to businesses that meet its statutory applicability requirements. If and when HBD becomes subject to that law or another state comprehensive privacy law, HBD will honor all rights and notices required by the applicable law.

HBD does not sell personal information for monetary compensation. Because analytics and advertising technologies can be treated as “sharing” or targeted advertising in some jurisdictions, eligible users may contact HBD to request an opt-out.

13. Children’s Privacy

The Platform is intended for a general audience and is not directed to children under 13. HBD does not knowingly collect personal information online from children under 13 without legally valid parental consent.

If you believe a child under 13 has provided personal information to HBD, contact us so that we can investigate and take appropriate action.

14. Third-Party Links and Listed Businesses

The Platform may link to listed businesses, social-media services, maps, payment processors, and other third parties. HBD does not control their privacy practices and is not responsible for how they collect, use, disclose, or secure information.

Review the privacy policies of third parties before providing them with personal information.

15. International Users

HBD is based in the United States. If you access the Platform from another country, your information may be transferred to and processed in the United States and other locations where HBD or its service providers operate.

Where applicable law requires additional protections for international transfers or grants additional privacy rights, HBD will take reasonable steps to provide those protections.

16. Do Not Track

Some browsers offer a “Do Not Track” setting. Because there is no single universally accepted standard for responding to these signals, the Platform may not respond to every Do Not Track signal. HBD will process legally recognized opt-out preference signals when required by applicable law.

17. Changes to This Privacy Policy

HBD may update this Privacy Policy to reflect changes in the Platform, business practices, technology, or applicable law.

The revised Policy will be posted with an updated effective date. HBD will provide additional notice when required by law or when changes materially affect how personal information is used.

18. Relationship to the Terms and Conditions

This Privacy Policy should be read together with HBD’s Terms and Conditions. If a provision of this Privacy Policy conflicts with a specific privacy right provided by applicable law, the applicable law will control.
